CNIL orders WhatsApp to stop sharing user data with Facebook

France's data protection agency on Monday told messaging app WhatsApp it needs to obtain users' permission to transfer some information to its parent company Facebook and gave it a month to comply.

This decision finally stopped the battle which began past year when WhatsApp updated their Terms of Service to add a clause detailing the sharing of data with Facebook for targeted advertisement. After which, CNIL made a decision to issue formal notice to WhatsApp to comply with the Data Protection Act within one month.

Upon investigating these claims, the CNIL ruled that while WhatsApp's intention of improving security measures was valid, the app's business intelligence reason wasn't as acceptable.

The chairlift at Tussey Mountain in Harris Township, Pennsylvania, became stuck Saturday morning after a malfunction. It took ski patrol and emergency officials about two hours to evacuate those who were stranded on the lift.

"The CNIL services have repeatedly asked WHATSAPP to provide them with a sample of French user data transmitted to FACEBOOK Inc". An investigation was then held to make sure WhatsApp had complied. The watchdog considered that the data transfer for "business intelligence" goal is not based on the legal basis required by the Data Protection Act for any processing. The authority rejected arguments by WhatsApp that it is subject only to the law of the US, saying that it becomes the authority in charge the moment any company is processing data in France.

The CNIL said WhatsApp did not have the legal basis to share user data with Facebook and had violated its obligation to cooperate with the French authority. A similar order has been presented to WhatsApp and Germany, and in the United Kingdom the social media giant has already agreed to stop collecting data from WhatsApp users. When installing the application, users must accept that their data are processed for the messaging service, but also, in general, by Facebook for accessory purposes such as the improvement of its service.

No further action will be take by the Cnil if WhatsApp complies with the order. The Chair of the CNIL considered that the data transfer from WHATSAPP to FACEBOOK Inc. for this "business intelligence" objective is not based on the legal basis required by the Data Protection Act for any processing. If it does not, the agency may appoint an internal investigator.
