Indian govt clears Bill on instant 'triple talaq'

Union Cabinet has now cleared the Triple Talaq bill, according to which, it is now illegal for Muslim men or women won't be able to divorce their spouse by just saying "Talaq" three times.

On Thursday, the West Bengal subcommittee of the Muslim Personal Law Board said that the proposed bill was drafted without consulting any Islamic scholars. He expressed concern that the government's attempt to expedite the introduction of legislation criminalising triple talaq without any attempt to appreciate the legal nuances involved.

Still, even after the verdict from the supreme court, there have been instances of Triple Talaq across the country and in a recent case, a man divorced his wife on whatsapp on the doubt that she was having an affair with someone else.

The apex court held that the triple talaq was against the basic tenets of Quran. She will also be entitled to her children's custody, the draft law says, media sources said.

Stating that Muslim women already had a right to seek maintenance from their husbands by virtue of Section 125 of the Code of Criminal Procedure (CrPC), he said when a legislation is made without accounting for awareness to the socio-culture context, it can have potentially disastrous consequences. The proposed law also creates provisions wherein the woman who is a victim of instant triple talaq can approach a magistrate seeking "subsistence allowance" for herself and minor children.

Giving instant triple talaq will be illegal and void and will attract a jail term of three years for the husband, according to the new law.

The bill is being introduced as the practice still continued despite the Supreme Court striking down "talaq-e- biddat" (instant triple talaq). He merely said many state governments, to whom the draft of the bill was sent, had supported the Bill.

The draft law was formulated by a team comprising Rajnath Singh, Sushma Swaraj, Arun Jaitley, Ravi Shankar Prasad and PP Chaudhary.
