It includes models that were previously recalled in March of 2009 and February of 2015.

"You're better off to have no fire extinguisher than a defective fire extinguisher", former California chief fire marshal James McMullen told CBS News. These have plastic handles or were the push-button Pindicator models. In addition, the CPSC says the nozzle can detach with enough force to pose an impact hazard.

Kiddle said almost 400 extinguishers incidents have been documented so far, resulting in one death, 16 injuries and 91 reports of property damage.

They were sold at Menards, Montgomery Ward, Sears, Home Depot, Wal-Mart and other home and hardware stores, as well as on Amazon.com, ShopKidde.com and assorted online retailers.

Kidde has recalled approximately 40 million fire extinguishers because they may fail to activate during an emergency.

The federal product safety agency also cited 391 reports of Kidde fire extinguishers that failed to work or had nozzles that detached. His family received a settlement from Kidde.

The recall involves more than 140 different devices produced between 1973 and this past September. Sixteen of those incidents resulted in injuries, including burns and smoke inhalation, the CPSC said. Or you can call the company at (855) 271-0773.

The recall FAQ section of Kidde's website says, "No proof of purchase is required". The new extinguishers contain metal parts instead of plastic.

Ann Marie Buerkle leads the agency ordering the recall. Units manufactured prior to 2007 do not have a date code printed on the fire extinguisher.
