A statement published today reveals that to date there is no evidence that the firm paid a South African government official, Transnet or Eskom employees.

In September this year, the DA laid charges of money laundering and corruption against the South African subsidiary of the software firm, after it emerged that R100 million in kickbacks allegedly changed hands between SAP and a Gupta-linked company, CAD House, for state business.

SAP SE has voluntarily disclosed the situation in its South Africa business to US authorities responsible for enforcing the US Foreign Corrupt Practices Act.

The wealthy Gupta family has come under scrutiny and has been accused of exerting undue influence over Zuma. South Africa's Corruption Watch has said it could report the firm to the DoJ, while the Federal Bureau of Investigation recently opened its own probe into United States links to the family, according to the Financial Times. The Guptas and Zuma deny wrongdoing.

An investigation by the U.S. Department of Justice and the U.S. Securities and Exchange Commission is ongoing and the company will fully cooperate, SAP said.

On Thursday Adaire Fox-Martin, a member of SAP's board, said: "We can not emphasise enough how seriously the SAP executive board takes these allegations, or how committed we are to managing this process in a transparent, ethical and responsible way". To this end, SAP has instituted formal disciplinary proceedings, in accordance with South African labour law, against three employees who were placed on administrative leave at the beginning of the investigation.

"Failure of the NPA to pursue this matter means the South African authorities have now outsourced their responsibilities of law and order to foreign nations like the U.S.".

The SAP board has since made a decision to eliminate sales commissions on all public sector deal, "In countries with a Corruption Perceptions Index (according to Transparency International) below 50, effective immediately". This includes SA, whose rating is 45.

The four contracts yielded some 660 million rand for SAP in revenues.

While SAP's statement initially sent shares down as much as 0.9 percent in Frankfurt trading, the stock has since rebounded, rising 0.4 percent to 95.83 euros as of 11:36 a.m. local time.
