"The continued stay of Rohingyas in India apart from being absolutely illegal is found to be having national security ramification and has serious security threats", the Centre said.

Meantime, police said on Monday that they had arrested a suspected member of al-Qaeda who they believed was trying to recruit Rohingya living in the country to fight security forces in Myanmar.

The lawyer representing the Rohingya said the Indian constitution "provides equal rights and liberty to every person", including non-citizens.

He told news agency ANI that if India decides to not allow Rohingyas then the global community can not ask it to take allow refugees.

The case is being heard as Bangladesh struggles with more than 410,000 Rohingya who have flooded across the border since August 25 when the military in Buddhist-dominated Myanmar launched a crackdown on the minority Muslim group.

Amid protests by sections of the island's influential Buddhist monks, who urged Sri Lanka not to accept Myanmar's Rohingya Muslims as refugees, the government has said it would not keep Rohingya asylum-seekers for long.

The Centre said India has not signed any worldwide treaty on refugees and was under no obligation to keep the Rohingyas, lakhs of whom have fled Myanmar over the past few weeks to escape a crackdown by government forces in the neighbouring country.

He said that India had sent a large quantity of relief material to Bangladesh but claimed that even Bangladesh had security concerns regarding Rohingyas.
