Trump Asks US Supreme Court to Restore Refugee Travel Ban

The Justice Department on Monday asked the Supreme Court to stop part of an appeals court ruling from going into effect that would limit enforcement of President Trump's refugee ban.

The appeals court decision, which affects about 24,000 refugees, could take effect on Tuesday.

The Justice Department wants to stay part of the appellate decision that said refugees should be allowed to enter if they have formal assurances from resettlement agencies that they will provide services when the refugees arrive.

In a one-page ruling, signed by Justice Anthony Kennedy, the Supreme Court announced that the exemption would be stayed pending a response from the state of Hawaii.

The department did not ask the court to immediately block a separate part of Thursday's ruling by the 9th Circuit that said grandparents, aunts, uncles and cousins of legal USA residents should be exempted from Trump's ban on travelers from six Muslim-majority countries.

Now with this, those who have family members in the U.S. or have a job, or are enrolled in American Universities can not be barred from entering the States.

Under the terms of Trump's order, the 90-day travel ban would end before the arguments even happen - on September 27.

The Justice Department asked the Supreme Court to place that decision on hold until the high court can review broader issues of the travel ban next month. Lower courts had blocked the ban, saying Trump overstepped his authority and unconstitutionally targeted Muslims.

"Unlike students who have been admitted to study at an American university, workers who have accepted jobs at an American company, and lecturers who come to speak to an American audience, refugees do not have any freestanding connection to resettlement agencies, separate and apart from the refugee-admissions process itself, by virtue of the agencies" assurance agreement with the government. The ban, plagued by legal challenges, had failed to take effect until that point.

As lower courts and the Supreme Court weighed in on the travel and refugee bans in recent months, the USA refugee program has lurched from an ambitious projection of 110,000 arrivals for the year, to just a few hundred arrivals a week.
