Judges affirm 'Making a Murderer' confession was coerced

Dassey and Avery's cases found worldwide attention after they were featured in the documentary series in 2015.

The appeals court handling "Making a Murderer" subject Brendan Dassey's case today upheld a 10-month-old ruling that the 27-year-old's murder conviction be overturned.

On Thursday, the appeals court released a 2-1 decision siding with Dassey that his confession to helping his uncle Steven Avery rape and kill Halbach on Halloween 2005 was coerced by Manitowoc County investigators. Investigators found burned human remains that matched Halbach's DNA, along with her auto, where they discovered multiple bloodstains.

A lawyer for Avery, who is now serving a life sentence, filed a motion this month, citing ineffective counsel as a reason for Avery to be freed or granted a new trial.

The three-judge panel from the court of appeals ruled on Thursday that the lower court's decision was correct, almost a year after the original decision.

In a 2-1 decision, the appeals panel affirmed that court's ruling, saying "no reasonable court" could have any confidence that Dassey's confession was voluntary. Speaking on WTMJ-AM, Schimel said his initial move would be asking the full 7th Circuit to review the panel's decision.

"The writ of habeas corpus is GRANTED unless the State of Wisconsin elects to retry Dassey within 90 days of issuance of this court's mandate, or of the Supreme Court's final mandate", the judges wrote.

Gerrymandering benefited GOP in 2016
But Republicans have a 7-4 majority in the state's congressional delegation and now control the state House 66-34. One of the largest Democratic congressional advantages was in Maryland, where Democrats controlled redistricting.

Two years later, Avery brought a United States $36-million lawsuit against Manitowoc County for the wrongful conviction. The director of the center, Steven Drizin, hopes that Dassey's successful appeal shows that interrogating a 16-year-old is not the same as interrogating an adult.

Netflix publicized a documentary in 2015 called "Making a Murderer", which highlighted the case but, according to authorities, was biased. Dassey was 16 then and suffered from cognitive problems. After several sessions, Dassey eventually confessed to being an accomplice to Halbach's rape and murder, and he was convicted for first-degree homicide, rape and mutilation of a corpse.

"The pattern of questions demonstrates that the message the investigators conveyed is that the 'truth" was what they wanted to hear.

The case against Dassey was constructed largely on that confession, in which he stated that he helped to rape and kill a woman named Teresa Halbach, as The Two-Way has reported. Given those factors, people felt Dassey was wrongly pressured into his confession.

However, this may still not be the end for Brendan Dassey. The follow-up episodes of the documentary series will follow Steven Avery's highly controversial case with his new legal representation as they challenge his conviction.

Brendan Dassey's attorneys announced Friday that they have filed a motion, asking for their client to be immediately released from custody.
