Court Upholds Overturned Conviction of Suspect in Netflix's 'Making a Murderer'

On Thursday, June 22nd, a federal appeals court chose to uphold a Wisconsin judge's decision to overturn Brendan Dassey's murder conviction. His uncle, Steven Avery, also is serving a life term in connection with the killing.

The state appealed Duffin's ruling, putting the case before the federal appeals panel.

As USA Today reported, this is a big victory for Dassey, and may lead to Steven Avery's nephew being released from prison.

Throughout the interrogation, investigators told Dassey, then a high school sophomore whose IQ had been measured between 74 and 81, that "honesty" is what they wanted to hear and that it's "the only thing that will set free". After that, Dassey was supposed to be released from prison in November, but the state filed an emergency injunction to keep him jail.

The Wisconsin Department of Justice has 90 days from the court's ruling to decide whether to re-try the case.

The ruling means Dassey could be released in the next 90 days.

"We continue to send our condolences to the Halbach family, as they have to suffer through another attempt by Mr. Dassey to re-litigate his guilty verdict and sentence", he added.

Dassey's attorneys say they're elated and will take immediate steps to secure his release.

The appellate panel split, with Judges Ilana Rovner and Ann Williams affirming and David Hamilton in dissent. It cited "the leading, the fact-feeding, the false promises, the manipulation of Dassey's desire to please" as among many factors that cast it in doubt. The court described the method used to get Dassey to confess as "death by a thousand cuts". "It calls into question standard interrogation techniques that courts have routinely found permissible, even in cases involving juveniles".

Making a Murderer investigated the killing of Ms Halbach, whose charred remains were found at Avery's auto salvage yard a week after she went there to photograph a minivan for sale, and the subsequent court cases.

"We are evaluating the 2-1 decision from the court", said Johnny Koremenos, director of communications and public affairs for the Wisconsin Department of Justice.

Dassey, then 16, told detectives he helped his uncle, Steven Avery, rape and kill photographer Teresa Halbach in 2005. And now it will be up to a Sheboygan County Judge, who's been assigned to the case because the trial judge has retired, to decided whether the motion has any merit.

Zellner has filed a post-conviction motion arguing Avery should be granted a new trial based on five arguments, including ineffective defense counsel, ethical violations by the prosecutor, and new evidence.

When considered with "Dassey's age, intellectual deficits, and the absence of a supportive adult", he considered the confession coerced.

A jury in 2007 found Dassey guilty of first-degree intentional homicide, second-degree sexual assault and mutilation of a corpse.

The case was the subject of the hit docu-series "Making a Murderer", a Netflix production that was released in December 2015.
