The challengers could still argue that even with a postponed effective date, the clock is now running, because the Ninth Circuit on Monday allowed the administration to go forward with provisions of the executive order directing an internal review of vetting procedures.

An executive order can not be divorced from its intent, and if the motivation behind it wasn't sufficiently clear before, Trump's recent tweetstorm of complaints about the "politically correct" version of the travel ban the Justice Department crafted (at his behest) after the initial version was struck down confirms that his intent hasn't changed. The Hawaii judge also blocked a 120-day ban on refugees entering the United States.

The court was responding to a request made by Acting Solicitor General Jeff Wall, who said in a letter that the ruling on Monday by the 9th U.S. Circuit Court of Appeals in San Francisco means the government needs to file a new brief. Trump nominated Gorsuch in January.

"The President is committed to protecting the American people and our national security, and we are proud to support his mission to put America first by defending his right to keep us safe", Sessions said, adding, "This is the reason why the Department of Justice will continue to seek further review by the Supreme Court". It is common practice for presidents to attend such events, which are purely ceremonial. Press secretary Sean Spicer dismissed the ruling, and said the White House remained confident it would be vindicated by the Supreme Court.

Under the amendment, the 90-day ban won't start until court orders now blocking it are lifted. Both are at stake in the Hawaii case; the Maryland case involves only the 90-day suspension of arrivals from the designated nations.

In its reply briefs submitted to the Supreme Court, the government argued that the "clarification forecloses respondents' mootness argument" and asked the Supreme Court to stay the Maryland and Hawaii injunctions, and grant a writ of certiorari to take the case.

U.S. Chief Circuit Judge Roger Gregory wrote that the text of Trump's executive order, which was challenged in courts across the country for targeting members of a particular faith, "speaks with vague words of national security, but in context drips with religious intolerance, animus, and discrimination". Whatever the Supreme Court does in this case, we probably haven't heard the end of the president's efforts to fulfill one of the basest, most un-American promises of his campaign.
