Hawaii urges court to keep hold on Trump travel ban

The judges largely affirmed U.S. District Court Judge Derrick Watson's decision from March which found the core provisions of the revised executive order - temporarily blocking all refugees and foreign nationals from six Muslim-majority countries from entering the U.S. - likely violated the Constitution because its primary goal was to disfavor Muslims but on slightly different grounds.

"From day one, I saw President Trump's Muslim ban for what it was, and so have multiple courts across the country", said Herring, in a news release.

On Monday, a three-judge panel of the Ninth Circuit Court of Appeals ruled against a revised version of the executive order, using the president's tweets against him in making their decision.

Even before Monday's ruling, the case was on the fast track to the Supreme Court, where the administration on June 1 filed an emergency request seeking to reinstate the order and hear its appeal of the 4th Circuit ruling.

"President Trump's Executive Order is well within his lawful authority to keep the Nation safe", Sessions stated.

When Trump issued his first executive order restricting entry into the country on January 27, he presented it as a temporary measure aimed at facilitating better screening procedures.

Judges Michael Hawkins, Ronald Gould and Richard Paez - all appointed by President Bill Clinton - said the president's order did not tie citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen to terrorist organisations or contributors to "active conflict".

Hawaii's lawyers said Trump had provided evidence that his administration already was doing the work that it said required a halt in travel to accomplish.

The ruling concluded that the executive order doesn't sufficiently justify suspending the entry of more than 180 million people "on the basis of nationality". "Further, the order runs afoul of other provisions. that prohibit nationality-based discrimination and require the president to follow a specific process when setting the annual cap on the admission of refugees".

Trump's suspension of the US refugee program also remains blocked.

The White House said Monday that it was reviewing the court's decision.

A federal judge in Hawaii also sided with the ban's opponents.

She said she did not expect the Supreme Court to consider the case before the fall, making it hard for the administration to defend its argument that the travel ban was urgently needed.

Hawaii Attorney General Doug Chin, who sued to stop the travel ban, said the 9th Circuit ruling "really shows that we have three branches of government and that there are checks and balances".

In his filing with the Supreme Court, ACLU attorney Omar C. Jadwat cited the impact of the ruling on the US Muslim community. Trump said in a post on Twitter, apparently referencing the U.S. Supreme Court.
