India is seeking the suspension of the death sentence handed to Jadhav by a Field General Court Martial (FGCM) in April this year.

India wants the ICJ to annul Jadhav's death sentence and for Pakistan to ensure that no action is taken that may prejudice the rights of India or of Jadhav.

Harish Salve, leading the Indian legal team, had focused his arguments on Pakistan's denial of consular access to Jadhav as he presented India's case before the judicial body.

ICJ president Ronny Abraham said the tribunal would publicly deliver its decision on whether to grant an emergency stay of execution "as soon as possible".

Meanwhile, Foreign policy fellow at Brookings India, Dhruva Jaishankar said Salve gave the Indian position quite clearly and he largely argued that since Jadhav had been denied consular access, this was the breach of the Vienna Convention and also his Indian nationalism was known by Pakistan because they have mentioned in FIR Jadhav's Indian nationality.

India appealed to the UN's top court to order Pakistan to suspend its planned execution of an Indian national convicted of spying.

Dr Muhammad Faisal told the court that under Vienna Convention the ICJ could not take up this case. He said India "cannot be hostage" to demands by Pakistan for joining the investigation without even granting consular access.

"It is clear from the Vienna Convention that the provision being sought under Article 36 by India can not be entertained by this court", Qureshi said in his 45-minute reply to arguments put forth by Indian counsel Harish Salve earlier. He said Indian Naval Commander Jadhav was arrested by Pakistani forces during an operation in Balochistan and he confessed killing of dozens of innocent Pakistanis. Islamabad also advocated an "expedited hearing which would dispel any suggestion for the need for provisional measures", adding that "Pakistan would be content for the court to list the application of India for hearing within six weeks".

Counsel Khawar Qureshi, who represented Pakistan at the ICJ, sought the "dismissal" of India's application, saying that there was "no urgency" because the clemency process would take 150 days.

On India invoking the Vienna Convention, Qureshi said, "The Vienna convention article 36 which adopted to set up standards of conduct particularly concerning communications and contact with nationals of the sending state which would contribute to the development of the friendly relations among nations.the observation we made immediately is this is unlikely to apply in the context of a spy, terrorist send by a state to engage in acts of terror". Dr Faisal said spies do not have rights of counsellor access and India did not produce evidence against Jadhav in the court. We submit that India's silence is telling.
