Chris Soules' arrest could change Bachelor in Paradise

Prosecutors are resisting the defense's motion to throw out criminal charges in the case of a fatal crash involving a reality TV star, and alleging he attempted to hide details about possible alcohol involvement in the collision.

In a filing on Tuesday, Buchanan County, Iowa, attorney Shawn M. Harden said that Soules bought alcohol at a convenience store prior to the crash that claimed the life of Kenneth Mosher, ABC News reports.

Soules' attorneys are trying to get the current charges against him dismissed, arguing in documents they filed in court Monday that the 911 call shows that he satisfied the requirements of the law by summing help, identifying himself to a 911 operator and staying until EMTs arrived, TMZ reported.

The prosecution states in new legal document that Chris went out of his way to avoid giving "an explanation" about "the empty and partially consumed open alcoholic beverages located in and around his vehicle that he was seen purchasing at a convenience store shortly before the accident." Oof. Prosecutors add that Soules fleeing the scene made it impossible for officers to determine his "level of intoxication".

Authorities say he left the scene after his truck rear-ended a man on a tractor last week.

In previous court documents, the police noted that there were alcoholic beverages found at the crash scene. "Mr. Soules remained on the scene with those emergency responders for several more minutes before returning to his home".

The former "Dancing With The Stars" alum was charged with leaving the scene of an accident that results in death. "Ultimately, Mr. Soules' 911 call establishes probable cause does not exist for the charge against Mr. Soules".

An additional motion for continuance was also filed and granted this past Friday, although a reason was not cited, and Soules' first hearing - initially set for May 2 - has been rescheduled for Tuesday, May 9 at 2PM at the Buchanan County Courthouse in Independence. Elite Daily reached out to a representative for Soules on the allegation, but did not hear back at the time of publication.
