Federal Judge Blocks Release of Posthumous Prince Record

"Deliverance", the album's title track, had already been made digitally available by Apple prior to Wednesday evening's ruling, but the company has since pulled the track from its online Music and iTunes platforms.

However, a suit stated Boxill entered into an agreement where Prince retained ownership of the music.

Friday marks the one-year anniversary of Prince's death from an accidental overdose. "Instead, Mr. Boxill maintained copies of certain tracks, waited until after Prince's tragic death, and is now attempting to release tracks without the authorization of the Estate and in violation of the agreement and applicable law".

A rep for Boxill said a statement is forthcoming, while a rep for the estate didn't immediately respond to Variety's request for comment. After the EP got pulled from iTunes earlier this week, a federal US judge granted the estate's request for a restraining order, effectively blocking the release.

As the title-track was released before the court's injunction, it's still available to purchase on princerogersnelson.com, a website run by the record label RMA, but the pre-order option for the entire EP has been removed.

The lawsuit argued the release of the recordings would "deprive Prince (and now the estate) from choosing what is released to the public and when". "Therefore the Deliverance single will continue to be sold", Matthew Wilson, a lawyer for the label, said in a statement to the publication. According to the Star-Tribune, Prince's estate now will have to submit a memorandum in support of the order.

Court documents reveal Boxill worked with Prince on several music recordings between 2004 and 2008.

And then, in February, Prince's estate made a deal with Universal Music Group for his music made after 1995, which includes some 25 albums.
