A federal judge ordered Volkswagen AG to pay a $2.8 billion criminal fine for rigging diesel-powered vehicles to cheat on government emissions tests, formalizing a punishment the German auto giant agreed to earlier this year in an unprecedented plea deal with US prosecutors.

Judge Sean Cox is holding a hearing Friday morning in federal court in Detroit. VW eventually admitted that the cars were programmed to turn pollution controls on during testing and off while on the road.

Damages for the entire United States emissions scandal earlier have topped now about $26bn, including criminal and civil settlements agreed earlier this year.

The Detroit News reported that VW lawyer Manfred Doess addressed Judge Cox on Friday before he imposed the sentence.

Separately, Volkswagen is paying $1.5bn in a civil case brought by the government and spending $11bn to buy back cars and offer other compensation.

"This is a case of deliberate, massive fraud perpetrated by VW management", Cox said.

Volkswagen pleaded guilty Friday to conspiracy and obstruction of justice and agreed to pay a $4.3 billion penalty for a brazen scheme to program almost 600,000 vehicles to cheat on U.S. emissions tests. Volkswagen, which remains under investigation in Germany, has reached settlements in the US with consumers, regulators, dealers, state attorneys general and federal prosecutors.
